Domestic violence assault allegations dismissed in Manhattan

Our client was arrested after our client’s ex-girlfriend and coworker complained that she was grabbed by the neck and assaulted causing physical injury and that our client left before the police arrived. He contact us and we arranged for our client to surrender so we could fight it in court. Our client was charged with assault in the third degree and harassment in the second degree and faced up to a year in jail and a permanent order of protection. Because they were coworkers, any order of protection could have caused our client to lose employment. In reviewing the complaint filed in court, we noticed that the New York State constitutional requirement pertaining to the corroboration of criminal court complaints had not been met and we moved to dismiss. Our client’s case was dismissed, the record sealed.
